Few hours ago police entered with a warrant into datacenter in Germany where our server is placed and confiscated one of our servers ( DE3 node ), to be more exact hard drives. Unfortunately by the german laws we could not be notified before the disc were taken away due to a fact that the data there could be erased. Unfortunately we cannot disclose the information about why the discs were taken away by the police. 

We have been notified about this one hour ago and we are already on the phone with our DC on what to do.

At the moment we have switched the drives but unfortunately we do not keep customers backups, meaning if you did not take offsite backups your data is lost ( as the discs can be in police property as long as the suspicious about some activity that was reported takes.. ). 

Please understand that we are as much surprised as you are and we are doing our best to resolve this situation.

At the moment we are in talks with our DC and in meantime we are already installing services ( the IP will be the same! ) for our clients there.

Also I would like to point out that, even its rare cases that this happens, we are not liable for any data loss or actions like this, even though, as we wrote before, its very rare!.

I must say that we planned to roll out backup system in following weeks for our clients ( as a feature ) but as this happened it has messed up our plans for that.

Actually mnost hosts, even OVH Cheap VPS make backups for use in emergency like this.
Those backups might only be used when it is NOT the user fault, this case would apply.

A host can take as many backups they want, in this case if the police find out they will take those drives as well.

Makes sense...
Never thought about that, that way.

Anyways, Police issues are with they erasing/deleting data, not having a backup... At least that is my POV.
